Time Warner Asks for Access Rule Enforcement

January 21, 2002 -- Time Warner Telecom Inc. (Nasdaq: TWTC) called for enforcement of a 1995 Texas statute requiring property owners to grant telecom providers fair and equal building access to deliver service requested by tenants.

"Time Warner Telecom is willing to pay fair and reasonable fees, on parity with the terms that building owners charge the incumbent telephone company, for access to their tenants," said Kristie Flippo, Vice President - Southwest Region Regulatory Affairs for Time Warner Telecom Inc.

"This issue is about preserving affordable 'access to the last foot' into a customer's premise," Ms. Flippo said. "Access to the 'last foot' is essential to preserving fair and equal telecommunications competition in Texas. Businesses in Texas should be able to receive the latest in telecommunications services at the most reasonable prices."

"The intent of the Texas statute is to bring the benefits of telecommunications competition to the public," Ms. Flippo added. "The building access provisions are designed to prevent building owners from keeping the savings and efficiencies that should rightfully belong to customers."

"We support the Texas Legislature who thought this issue through over six years ago and felt it was important enough to write statutory provisions to give the Public Utility Commission the authority to enforce fair and equal access," Ms. Flippo said. "Without this enforcement, a building owner could, and often does, prevent competitive providers from bringing telecom services to tenants."

"Many tenants are asking for service from competitive providers to ensure network survivability in the event of natural or other disasters," Ms. Flippo said. "If we can't enter a building cost effectively, then those tenants are denied the quality service we deliver."

The Texas Building Owners and Managers Association (BOMA) recently filed a lawsuit challenging the constitutionality and fairness of the state statute.

"Overturning a state statute, as BOMA asks, is counterproductive and we disagree with many of the so-called facts of their lawsuit," Ms. Flippo added.

"Time Warner Telecom supports the Texas ruling in its present form," said Ms. Flippo. "Our customers are requesting the high-quality and reliable broadband services we deliver over our optical networks because we have established a solid track record.
